An appearance in connection with a request the Board waive the $360 campaign finance late fee assessed against Larry Spencer, a candidate for Justice of the Peace, East Baton Rouge Parish in the October 19, 2013 election, whose EDE-P campaign finance disclosure report was filed 9 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Larry Spencer, states that this is the first political office he has run for and he was not familiar with the reporting process. He states that he did not choose not to file, it was an oversight. He further states that his treasurer had some family health issues that came up during that time and they were not able to meet to discuss all of the responsibilities. He says there were no new expenses to report for the election day. They used all volunteer workers and previous signs without any new advertising. There were no payments to any organizations.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Suspend all but $200 based on future compliance.
