In connection with a request the Board waive the $600 campaign finance late fee assessed against Kelli Terrell Temple, a candidate for Judge, City Court, City of East Baton Rouge, East Baton Rouge Parish in the May 2, 2009 election, whose 2012 Supplemental campaign finance disclosure report was filed 244 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Kelli Terrell Temple states that Leigh Holdiness Davis with Phoenix Financial Group prepares her campaign finance reports. The candidate report for the November 6, 2012 election for which she was unopposed was due by February 15, 2013 and was timely filed on February 13, 2013. Unfortunately the candidate supplemental report for the deficit from her 2009 was not reported on that date. On October 17, 2013 when she became aware of the filing omission she immediately contacted the staff member who sent the letter to get clarification on what she was missing. She states that she then contacted Mrs. Davis who contacted the same staff member and the supplemental report was filed that day. She says that at the time of the filing, she was not aware that there was a continuing obligation to file reports for previous elections (when there is a deficit or surplus) when a report is due for the current election. She says she assures the board that she takes the law and the following of it very seriously and would in now way deliberately disregard a reporting obligation. The need to file the supplemental report for a previous election was the first time this occurred for me as an elected official. She states that her campaign is already in a deficit situation and the fee would create an additional financial burden on already strained resources.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
