RE:
Advisory opinion request from the Town of Homer a regarding potential Ethics violations by Mayor Smith and other employees of the Town.
Facts:
The Town of Homer has written requesting to withdraw the advisory opinion request regarding whether it is acceptable for Mayor Smith to authorize payments to Smith's Medical Supply, a company owned by her husband.

It appears that Smith's Medical Supply has had a contract with the Town prior to Mayor Smith being elected. Smith's Medical Supply has been contracted to remove dead bodies from the Town. Since the time of the request the Town has decided to implement a plan that will ensure that the Mayor will not participate in any transaction involving Smith's Medical supply.

Comments:
The advisory opinion request has been withdrawn.
Law:
La. R.S. 42:1112A. No public servant shall participate in a transaction involving the governmental entity in which he has a substantial economic interest.

La. R.S. 42:1112B3. No public servant shall participate in a transaction involving the governmental entity in which any person of which he is an officer, director, trustee, partner or employee has a substantial economic interest.

La. R.S. 42:1113A.(1)(a) No public servant or member of his immediate family or legal entity which he has controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Allow the withdrawal of the opinion request. Further adivse that the Town of Homer must submit any future disqualification plan to the Board of Ethics for approval.
