In connection with a request the Board waive the $240 campaign finance late fee assessed against Christia "Tia" Simmons, a candidate for Alderman at Large, City of Jeanerette, Iberia Parish, in the October 19, 2013 election, whose EDE-P campaign finance disclosure report was filed 6 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Christia "Tia" Simmons states that throughout her campaign she has timely filed many reports. When preparing her final candidate's report she also prepared her EDE-P report which was due October 29, 2013. She states her plan was to mail both her final report and EDE-P report in the same envelope (envelope mailed October 28, 2013) that would complete her requirements to the Board. She thought she had done that until November 4, 2013 when she received a certified letter indicating she had not filed her EDE-P report. She says she immediately called and spoke to Angela and indicated that she had filed it in the same envelope as her candidate's final report which was received in a timely manner. Angela indicated that she saved the envelope and she would check to make sure it was not overlooked. Angela called her back and indicated it was not with the other report. She says she immediately faxed the report to the Board of Ethics and verified that it had been received. She says she is asking for relief from the penalty, as it was simply human error. She says at no time in this process has she attempted not to file the required reports in a timely manner.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Suspend all but $200 based on future compliance.
