An appearance in connection with a request the Board waive the $2,000 campaign finance late fee assessed against Joel Boe, a candidate for Councilman, Metro District 9, East Baton Rouge Parish in the November 6, 2012 election, whose EDE-P campaign finance disclosure report was filed 25 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Joel Boe states that he hand delivered the EDE-P report to the Board of Ethics on November 14, 2012. He says the time stamp shows it was delivered and accepted in advance of the November 16, 2012 deadline. The instructions on the form generated from the Board of Ethics system clearly states that this document should be hand delivered or mailed. In the top 1/3 of the document, it states: Hand deliver or mail to: Campaign Finance 8401 United Plaza Blvd., Suite 200, Baton Rouge, LA 70809-7179. He says not only does the Board of Ethics document say to hand deliver or mail but it directs you to the improper address. He says that due to a delinquency notice that he received in early December of 2012, this document was submitted electronically on December 11, 2012. It is now his understanding that regardless of the improper instructions that are shown on the Board of Ethics paperwork that all forms should be filed electronically from this day forward. He says he is asking for the late penalties in the amount of $2,000 to be dismissed since he hand delivered the document per the instructions and in advance of the due date.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Waive the late fee.
