Untimely waiver request submitted by Gaddie W. Baker, a member of the Board of Examiners for Speech/Language Pathology and Auditory, regarding a $1500 late fee assessed for filing her 2010 Tier 2.1 annual pfd 335 days late.
Facts:
The deadline for requesting a waiver or paying the $1500 late fee was September 6, 2013. Neither was received. Ms. Baker filed a waiver on October 15, 2013. It was 39 days late.

Ms. Baker states that she was having a difficult time during the time that she was required to file. Her husband suffers from multiple health problems including: hypertension, diabetes, hepatic encephalopathy. He also fractured his pelvis and needs assistance with daily living needs. He is unable to work and Ms. Baker says she is the sole provider for the family of five. She says the imposition of the late fee would cause a financial hardship. On October 31, 2013, a request for supporting documentation was sent to Ms. Baker.

The deadline for submitting the information is December 2, 2013. On December 2, 2013 Ms. Baker submitted letters from medical professionals stating that Mr. Baker is undergoing medical treatment and is disable from cirrhosis and end stage liver disease.

OTHER LATE FILINGS: Yes, Ms. Baker also has an outstanding late fee of $1200 for failing to timely file a 2008 Tier 2.1 annual pfd. A Late Fee Order was issued on July 31, 2012. The due date to request a waiver or submit payment was August 31, 2012.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.


Recommendations:
2008 - waive the late fee.

2010 - suspend all but $250 based on future compliance.
