Waiver request submitted by John Gordon Sorey, a Richland Parish Constable, regarding a $1100 late fee assessed for filing his 2012 tier 2 annual pfd 11 days late.
Facts:
Mr. Sorey has a total of $1,800 in outstanding late fees. Mr. Sorey states that the imposition of the late fee would cause a financial hardship. He is going through a divorce and paying for his daughter's college education ($2,432.80). He says he has been unemployed since April and living on a limited budget.

Mr. Sorey also states that he does not have a computer to print the required forms. He has gotten assistance from someone at his local bank to assist him with printing the forms. He now has the forms to file for the upcoming year.

Mr. Sorey has submitted documentation of a receipt from Louisiana Delta Community College for Stella Sorey. He has also submitted documentation of petition for divorce from Donna Sorey.

OTHER LATE FILINGS: Yes, At the March 2012 Board meeting (Docket No. 2012-140), the Ethics Board suspended $700 of the original $700 late fee related to the late filing of his 2010 Tier 2 Annual Personal Finance Disclosure Statement. It was filed 7 days late. The $700 has been reassessed.
Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Decline to waive the $700 reassessment. Suspend all but $300 of the 2012 late fee based on future compliance. Offer a payment plan.
