In connection with her request that the Board waive the late fees assessed for the late filing of the reports, Julie Kay Disotell Harrington states that she sent in a waiver request in the beginning of April. She says she is not sure what happened but when she received notices from the Board she called and spoke with someone who stated the request was not in her file. She says unfortunately she did not send them certified. She says she actually sent in the request before she received anything from the board, so she was extremely concerned upon receiving notices that were dated several months earlier. She says this was the first time she actually campaigned during an election and was not familiar with the processes and ended up not filing some of the reports. She says thankfully the people in the ethics office were very helpful to her and actually assisted her in completing and filing the correct reports.
She says that in addition to not being familiar with the reporting system, while campaigning she was also the primary caregiver and medical decision maker for her younger brother that was dying from ALS. During her campaign his condition worsened. Right after the election, his condition became critical and he died in May of 2012. During all of this, she was no longer focused on the election and didn't realize that she received notice from the Board that her reports were not completed. As soon as she received notice, she called someone at the Board and stayed on the phone with her and helped her complete the correct forms and file them. She further states that she would like to resolve this as soon as possible because she will be having major back surgery on and she is not sure what type of condition she will be in after that due to the nature of her spinal injuries.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
