Advisory opinion request concerning the propriety of the New Orleans Civil Service Commission and the New Orleans Civil Service Department contracting with James Mullaly and Victor Papai, two attorneys who formerly worked for the New Orleans City Attorney's Office.
Facts:
The New Orleans Civil Service Commission and the New Orleans Civil Service Department are considering contracting with James Mullaly and Victor Papai to serve as Hearing Examiners. James Mullaly and Victor Papai were formerly employed as Deputy City Attorneys for the New Orleans City Attorney's Office. They were both involved in representing the City Attorney's Office in civil service appeals before the New Orleans Civil Service Commission. Mr. Papai and Mr. Mullaly left their employment with the New Orleans City Attorney's Office in August, 2012 and October, 2012, respectively.
Law:
Section 1121B of the Ethics Code prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction involving the agency of the former public employee, in which the public employee participated at any time during his public employment. Additionally, Section 1121B prohibits a former public employee, for a period of two years following the termination of his public employment, from contracting with his former agency to provide the same services as he provided while a public employee.

Section 1102(16) of the Code defines "person" as an individual or legal entity other than a governmental entity, or agency thereof.

Recommendations:
Adopt the proposed advisory opinion.
