Waiver request submitted by Thomas Arnold, Sr., a former Orleans Parish Assessor, regarding a $2,500 late fee assessed for filing his 2010 Tier 2 annual pfd 386 days late and an untimely waiver request regarding a $2,500 late fee assessed for filing his 2009 Tier 2 annual pfd 426 days late.
Facts:
The following information was submitted by Mr. Arnold in connection with a waiver request involving campaign finance fines at the July 2013 board meeting. At that meeting, the Board rescinded Mr. Arnold's campaign finance fines. Mr. Arnold asked that this information be considered in connection with these late fees.

Thomas L. Arnold, Sr. states that he is retired and trying to recover from serious heart and spine problems. There is no chance of him ever running for office again.
Mr. Arnold has submitted medical documentation which shows that during the campaign for the election held on February 6, 2010 that he suffered from a condition known as Barrett's Esophagus and had a procedure completed in March 2010. A second surgery was completed in September 2010. Gastric Sleeve Surgery was completed in May 2010. Prior to the surgery it appears that Mr. Arnold was in and out of the hospital with pain to his stomach and digestive system.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Waive the late fees.
