Waiver request submitted by Jeffery Churchwell, a member of the Morehouse Parish School Board, regarding $400 late fee assessed for filing his 2013 School Board Disclosure Statement 8 days late.
Facts:
Jeffery Churchwell is a member of the Morehouse Parish School Board. His brother-in-law and wife are employed by the Beekman Charter School. Beekman was a school once under the jurisdiction of the Morehouse Parish School Board. However, it has been converted to a Type 3 Charter School, which is a charter that exists pursuant to a charter between the school board and a nonprofit, which runs the school. Beekman is managed by its own Board of Directors. As such, his wife and brother-in-law are not "employed" by the Morehouse Parish School Board, but by the nonprofit that runs the charter school.

Law:
La. R.S. 42:1119B(2)(a)(iii) requires that within thirty days after the beginning of each school year, any school board member or superintendent whose immediate family member is employed by the school board shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement may be assessed a late fee of fifty dollars per day, not to exceed $1,500.

Recommendations:
Rescind the late fee.
