Untimely waiver request submitted by Rickey Hollins, a Concordia Parish Constable, District 2, regarding a $1500 late fee assessed for filing his 2011 Tier 3 annual pfd 131 days late, a $1500 late fee assessed for filing his 2009 Tier 3 annual pfd 259 days late, and a $700 late fee assessed for filing his 2010 Tier 3 annual pfd 14 days late.
Facts:
December 9, 2013 was the deadline for submitting a waiver for the late fees associated with his $1500 late fee assessed for filing his 2011 Tier 2 annual pfd 131 days late. He submitted a waiver request on December 16, 2013. It was 7 days late.

Mr. Hollins has two outstanding late fees. The staff has begun the process of filing a petition for collection of the late fees.

In total, Mr. Hollins has $3700 in outstanding late fees due and owing. Mr. Hollins requests that the fine for the 2009 pfd be reduced to $700 and the fine for the 2010 pfd be reduced to $350 so that he may immediately pay the total of $1,050.

Mr. Hollins does not address the $1,500 late fee associated with the 2011 pfd late filing.

A request for supporting documentation regarding the financial hardship was issued with a due date of February 28, 2014. No response was received.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Decline to waive and offer a payment plan.
