RE:
Waiver request submitted by Ronald Vollmar, member of the Morehouse Parish School Board, regarding a $400 late fee assessed for filing a 2013-2014 school board disclosure statement 8 days late.
Facts:
Ronald Vollmar is a member of the Morehouse Parish School Board. In years past, his wife has been employed with the school board as a certified teacher, teaching in a classroom. As such, Mr. Vollmar was required to file annual school board disclosure statements within 30 days of the first day of school. This year his wife was not employed by the school board, but is a teacher with Beekman Charter School, which is located in Morehouse Parish. However, the school is operated by a nonprofit with a board of directors. Morehouse Parish School Board does not control the everyday functions of the charter school, handle the hiring or firing or any other personnel matters.

Law:
La. R.S. 42:1119B(2)(a)(iii) requires that within thirty days after the beginning of each school year, any school board member or superintendent whose immediate family member is employed by the school board shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement may be assessed a late fee of fifty dollars per day, not to exceed $1,500.

Recommendations:
Rescind the late fee.
