RE:
Request that the Board reconsider to waive the $240 and $360 campaign finance late fees assessed against Brett A. Bonin, a candidate for Orleans Parish School Board, District 3, in the November 6, 2012 election, whose EDE-P and 10-G campaign finance disclosure reports were filed 4 and 6 days late.
Facts:
In connection with his request for a reconsideration of a waiver of the $240 and $360 late fees assessed for the late filings of an EDE-P and 10-G campaign finance reports, Brett A. Bonin states that the version of Leaders software that his accountant was using indicated that campaign workers' social security numbers were needed and Leaders would not let him continue with filing the report. Multiple campaign workers from Orleans Parish refused to give them their social security number citing that they were not required to provide one. Eventually, he contacted the Campaign Finance division, and found out that the workers were in fact not required. Mr. Bonin maintains that the delay in filing the EDE-P report was solely related to trying to obtain social security numbers from campaign workers. As for the 10-G report, Mr. Bonin states that his accountant's assistant abruptly left her employment prior to the report being due. The lateness of the report was due to the additional time needed by his accountant to learn the Leaders software and personally key in the report, while struggling with the additional back-log of work caused by his losing his long-time assistant. Mr. Bonin is a district level candidate. This is his second campaign. He was an unsuccessful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2012, Act 25 of the 2008 2nd Extraordinary Session requires Major and District office level candidates to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.

Recommendations:
Suspend all but $200 on the EDE-P report and decline to waive the late fee assessed for the 10-G.
