Waiver request submitted by Jade Alese Brown-Russell, a member of the Downtown Development District (Orleans Parish), regarding a $200 late fee assessed for filing her 2009 Tier 2.1 annual pfd 4 days late and a $200 late fee assessed for filing her 2011 Tier 2.1 annual pfd 4 days late.
Facts:
Ms. Brown-Russell states that she faxed her 2009 and 2011 reports in July 2013 and the fax rang busy and was not complete. She states State Police served her with the 2011 notice of delinquency in November 2013.

A review of our records on July 16, 2013 Ms. Brown-Russell's reports were received by the office, but they were received 4 days late. On June 11, 2013 a subpoena was issued to personally serve Ms. Brown-Russell because the original notice of delinquency was returned to our office as unclaimed. Ms. Brown-Russell called the office on June 27, 2013 to inquire about the certified mail that was already returned before she was to able pick it up from the post office. At that point, the 2009 and 2011 notices were sent to Ms. Brown-Russell's work address at her request. In November 2013, the State Police served the June 2013 notice to Ms. Brown-Russell.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
