In connection with his request that the Board waive the late fee assessed for the late filing of the report, Mr. Dale states that he is in receipt on November 15, 2013 of the assessment of a late filing fee relating to the Jefferson Parish School Board seven mill property tax proposition of October 19, 2013. He requests a waiver of the $880.00 fine. He states as a member of the Jefferson Parish School Board, he understood that the filing of the regular campaign report would include the amounts expended on behalf of this proposition and did not understand that there was a separate filing requirements, as an individual.
When the matter came to his attention, he immediately investigated the proper method of filing and initiated the preparation of a filing which was filed on a regular campaign report. Based on subsequent notification from our office in a telephone conversation, he filed the appropriate form 301 Special Report Form for Propositions/Recall Elections (filed on November 5, 2013) and Form 300 the Report for Proposition/Recall Elections (filed November 27, 2013). He states that the forms were completed and filed with our office on November 7 and November 27, 2013. He states the filing of the reports with our office was taken without specific request by our office and was initiated at his direction. He believes that this demonstrates his commitment to file timely the required reports to our office. He says he does not have a history of late filings and this filing form is unusual.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
