Advisory Opinion request regarding how the post-employment restrictions will effect Mr. Cliff Vanicor, a former Calcasieu Paris Police Jury (CPPJ) employee.
Facts:
Mr. Vanicor was employed by CPPJ as a Professional Engineer until January 3, 2014. He has recently accepted employment with C.H. Fenstermaker and Associates, L.L.C. as an Engineer I. He has requested an opinion regarding whether he is prohibited on working on federal, state, local, parish and private contracts with Fenstermaker as a design engineer.


As a Professional Engineer for CPPJ Mr. Vanicor worked in the CPPJ Division of Public Works. The Professional Engineer position has no direct supervision over any employees. This position reports directly to the Assistant Director of Public works for CPPJ. Mr. Vanicor's has stated that his job duties included managing all engineering projects, consulting with vendors, developing cost estimates for projects, project inspection, and reviewing drainage plans for CPPJ, Division of Public Works.

Law:
La. R.S. 42:1121 B(1) provides that no former public employee shall, for a period of two years following termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
