In connection with a request the Board waive the $200 campaign finance late fee assessed against Zoe Olivia Fleming, a candidate for Judge, Juvenile Court, Section C, Jefferson Parish in the October 19, 2013 election, whose EDE-G campaign finance disclosure report was filed 2 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Zoe Olivia Fleming states that she asks the Board to note that as an attorney, running for judgeship, she is prohibited from any financial involvement in a judicial campaign. Therefore it seems unfair that she is penalized for not having filed a timely report with our department regarding finances, when the Supreme Court tells her that if she does anything of that nature, then she runs afoul of the judicial cannon of ethics. She states that given the above, she cannot win for losing. She asks the Board to permit her to PAY the assessment but determine that it was not due to any actions on her part. She also notes that for the past 8 weeks she has been quite ill. The doctor wrote a medical excuse for her explaining that she was not to talk.

She was tested for the flu, pneumonia, x rayed to see if there was an object in her lungs, given steroids, cortisone shorts, powders as a medication to inhale in her lungs, bronchial inhalants, breathing treatments and every thing but a witch doctor to preside over the entire episode. She states that she has been diagnosed with acute bronchitis and laryngitis and her doctor has advised that she believes she may have permanent vocal chord damages. She states that she has enclosed a money order for the $200 fine and seeks that the Board issue a determination that it was not her fault that the report was not filed timely.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
