Advisory opinion regarding whether Paul Toups, a State Trooper, may accept employment with Alpha Trident Group.
Facts:
Paul Toups is a Louisiana State Trooper and has been employed with the Louisiana State Police since 1994. He is a certified Police Officer Standard of Training firearms instructor. He would like to accept employment with Alpha Trident Group. Alpha Trident Group is a private security company. Mr. Toups would be be employed with Alpha as a "qualifying agent". A qualifying agent is an individual qualified to oversee and supervise alarm systems contractor operations including offers to sell, install, service or monitor alarm systems, signal devices, fire alarms, burglar alarms, television cameras or still cameras used to detect fire, burglary, breaking and/or entering, intrusion, shoplifting, pilferage or theft. Mr. Toups would be responsible for teaching firearm courses for the company. Alpha does not have contracts with or any other business relationship with the State. Mr. Toups is a shift worker for the Louisiana Police Department and would only teach classes at Alpha during his off time.
Law:
Section 1111C(1)(a) prohibits a public servant from receiving any thing of economic value from an outside source for the performance of services which are devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.
Recommendations:
Adopt the proposed advisory opinion.
