Advisory opinion regarding whether Justin Cox, a member of the Pointe Coupee Parish Police Jury, may participate in the vote to appoint members to the Health Service District Board while he is employed with Acadian Ambulance.
Facts:
In Docket No. 2010-1107, the Board rendered an advisory opinion to Justin Cox regarding his continued employment with Acadian Ambulance if he was to be elected to the Pointe Coupee Parish Police Jury. The Board advised that Mr. Cox could continue his employment as he did not own a controlling interest in Acadian Ambulance and the elements set forth in 82-02D were met. Mr. Cox was advised that he would need to recuse himself from matters involving Acadian Ambulance that may come before the Police Jury.

Mr. Bergeron is requesting clarification of the 2010-1107 advisory opinion to determine whether Mr. Cox can participate in the vote to appoint members to the Health Service District since the Health Service District members determine which ambulance company to contract with.

Comments:
Joseph Bergeron is requesting this advisory opinion. Mr. Bergeron is a former member of the Pointe Coupee Parish Police Jury. He was defeated by Justin Cox. Mr. Bergeron does not have standing to request this opinion regarding the prospective actions of Justin Cox.

Law:
La. R.S. 42:1112B(3) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any person of which he is an officer, director, trustee, partner, or employee has a substantial economic interest.

Recommendations:
Decline to render for lack of standing.
