Advisory opinion request from Maury O. Chatellier, concerning his potential employment with a private consulting firm after the termination of his employment with the Louisiana Coastal Protection and Restoration Authority.
Facts:
Louisiana Coastal Protection and Restoration Authority (CPRA) is divided into five divisions including Executive, Operations, Program and Project Management, Planning and Research, and Engineering. The position Mr. Chatellier holds with CPRA is Chief of the Engineering Division. In that capacity, Mr. Chatellier oversees 25 professionals and sub-professionals whose responsibility is the technical merit of engineering and design work produced by the agency. His oversight is specific to the Engineering Division and does not expand into other divisions within the agency. Mr. Chatellier intends to accept employment with Dewberry, a private consulting firm, after he terminates his employment with CPRA. His duties with Dewberry would involve consultation with CPRA regarding matters other than engineering and design efforts that he had oversight over as Chief of the Engineering Division.
Law:
Section 1121A(1) of the Code prohibits a former agency head, for a period of two years following the termination of his public service as the head of such agency, from assisting a person, for compensation, in a transaction or in an appearance in connection with a transaction, involving his former agency. Furthermore, Section 1121A(1) prohibits a former agency head from rendering, on a contractual basis, any service to or for his former agency for a period of two years.

Section 1121B states that no former public employee for a period of two years following the termination of his public employment shall assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed.

Recommendations:
Adopt the proposed advisory opinion.
