Request for advisory opinion regarding Pineville City Court Clerks and dual office-holding
Facts:
Pineville City Court clerks are collecting bond/fines and costs. They are also being appointed by a judge as misdemeanor probation officers. They are collecting fees as set forth in the same disposition. The clerks salaries are paid by the court operating expense account and the Pineville Probation Program Account.
Law:
1112 A No public servant, except as provided in R.S. 42:1120, shall participate in a transaction in which he has a personal substantial economic interest of which he may be reasonably expected to know involving the governmental entity.
Recommendations:
Decline to render an opinion as it pertains to past conduct.
