Advisory opinion regarding whether Talisha Chiquet may be appointed to the Lafourche Parish Library Board of Control while her father-in-law sits as the Library Branch Administrator and whether Angelique Torres maybe appointed to the Lafourche Parish Library Board while her sister is employed as a Library coordinator.
Facts:
Angelique Torres is seeking to be appointed to the Lafourche Parish Library Board. Mrs. Torres is the cousin of Council Member Philip Gouaux's late wife. Mrs. Torres's sister, Trina Griffin, is employed at the Library as a Southern Area Coordinator. She has been employed since 1999.

Talisha Chiquet is seeking to be appointed to the Lafourche Parish Library Board. Mrs. Chiquet is the daughter in law of Library Branch Administrator Mr. Paul Chiquet. Mr. Paul Chiquet has been employed since 1998.


The Lafourche Parish Council appoints the board members. The Board is an advisory board and does not have corporate powers. Although the Board cannot purchase property, it is responsible for hiring and firing the Library Director. The Director is responsible for overseeing the day to day operations of the Library.

Law:
Section 1119A of the Code prohibits the immediate family members of an agency head from being employed in the agency of the agency head. Section 1119C of the Code allows the continued employment and normal promotional advancement of an immediate family member if he was employed for more than one year prior to the public employee's immediate family member becoming an agency head.

Section 1112B(1) of the Code prohibits a public servant from participating in transactions with their governmental entity in which an immediate family member has a substantial economic interest.
Recommendations:
Adopt the proposed advisory opinion.
