Request that the Board reconsider to waive the $600 campaign finance late fee assessed against Hillery Godfred Johnson, a candidate for Councilman, Metro District 2, in the November 6, 2011 election, whose Supplemental campaign finance disclosure report was filed 35 days late.
Facts:
In connection with the request that the Board reconsider to waive the late fee assessed for the late filing of the report, Barbara S. Johnson on behalf of Hillery Johnson states that she was helping Mr. Johnson complete his reports. This was her first time working with campaign reports and after reading the instructions for a supplemental report she concluded that since he did not win the election and there was no monies left in the campaign account that he did not have to file. The report was filed after they received notification that the report was due.This was the candidate's second campaign.

Mr. Johnson's brother Sheldon Johnson sent in the request for reconsideration. He states that he was the secretary/treasurer for the campaign. This was his first time he held a position dealing directly with the campaign. He states he was skeptical because he had never done this before. He felt obligated since Mr. Johnson is his older brother and that unknowing his health was failing. He says that in October of 2011 while training to be a LSU police officer he had developed a coughing episode that he coughed so hard he cracked his ribs. That same day he started getting extreme pains when he coughed, sneezed or laughed hard. That continued for several weeks until he decided to seek medical help.

After going to 6 doctor's appointments with three different doctors and two hospital emergency visits he could hardly walk because he was in so much pain. After a four day stay and numerous test it was determined that he had multiple myeloma, a type of cancer that produces plenty of white blood cells that attaches to the bones and make them weak and fragile. He states that he started cancer treatment in April 2012 and the treatment lasted 7 to 8 months. The treatment consisted of chemotherapy, taking various medications, having blood test weekly, and getting shots weekly. He states that after he was in remission he remained in pain so he was advised to seek a bone marrow transplant. This took several months and was done in August of 2013 and he is still under the doctors care. He states when staying in New Orleans for weeks at a time he had to have someone with him 24/7 and his brother Mr. Johnson stayed with him because his wife was unable, due to her job.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
