RE:
Request that the Board waive the $400 and $400 campaign finance late fee assessed against Archie L. Martin, Jr., a candidate for Mayor, Village of Anacoco, Vernon Parish in the November 6, 2012 Election, whose 10-P and 10-G campaign finance disclosure reports were filed 374 and 345 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the reports, Mr. William Dyess, attorney for Archie L. Martin Jr. states that Mr. Martin is a 70 year old elderly man who had severe health problems following the November 6, 2012 election for Mayor of the Village of Anacoco. He was hospitalized shortly after the election for gallbladder surgery and had complications following surgery. Due to his health problems he was unable to immediately handle the ethics board report problems surrounding this case. He also states that in addition Mr. Martin lives off of a fixed income due to his age and dependency on Social Security Benefits.

He states that he previously paid $900.00 to the Board of Ethics and received a letter from Ms. Andrieu which specifically stated "this matter is now closed". He has attached the letter for reference. Mr. Martin believed that was the total and final amount of fines he owed to resolve this matter. He states that his office previously filed the three reports (form 102 as an amended 30-P, new 10-P and new 10-G) that was requested, and it is his understanding that this was the final step to close this matter once and for all.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
