RE:
Request the Board waive the $500 campaign finance late fee assessed against Frank Minyard, a candidate for Coroner, Orleans Parish in the February 2, 2014 election, whose 30-P campaign finance disclosure report was filed 5 days late.
Facts:
In connection with the request that the Board waive the late fee assessed for the late filing of the report, Rachael Gagliano, secretary for Frank Minyard, states that in her duties of employment with Dr. Minyard, she acquired the task of filing his Campaign Finance Disclosure Reports. She says this was her first year doing that task. She states that prior to receiving the delinquency letter she made several calls to the Board of Ethics because Dr. Minyard was planning to drop out of the election. She says that she asked if any other type of documentation was needed to be filed and she was told no.

She said that they waived the filing of the personal financial disclosure because Dr. Minyard's 2013 personal financial disclosure was filed already since he was already in office. She says also that Dr. Minyard dropped out of the election before December 23, 2013 thus he does not have any Campaign Finances to disclose. She says that online on the Board's website it states that a 30-P covers any Campaign Finances from December 23, 2013 due on January 2, 2014, Dr. Minyard was not only not in the election any longer at this time, he never raised or spent any money campaigning of any kind at any time.

She states the only reason this report was not filed in a timely manner is because not only was she informed by the Board of Ethics that nothing else was needed if he was dropping out, the Board website states (under schedule of reporting and filing dates) 30-P reports cover period through December 23, 2013 and due on January 2, 2014 to which Dr. Minyard had already dropped out of the election.

She respectfully asks the Board to take into consideration all of the above and either waive or reduce the fees set at $500. She also asks that the Board to take into consideration that as soon as she received the delinquency letter she got on the phone with the Board of Ethics to resolve this problem. The report shows that he has no campaign finances.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
