Request that the Board waive the $2,500 campaign finance late fee assessed against Glenn B. Gremillion, a candidate for Judge, Court of Appeals, Third Circuit in the February 1, 2014 Election, whose 2012 Annual campaign finance disclosure report was filed 335 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Mr. Gremillion states he would like to explain his mistake in not timely filing his 2012 Annual Report timely. He says that he thought he filed it. He says he has a copy of the statement in his file on which he marked "filed, 1/12/13 @ 2:50 pm". He says he is not very competent with computers. He states evidently he did not complete the submission process and hit the "submit" button.

When he was told that he had not filed, he was able to file his 2012 report within minutes of filing his 2013 report because it was already prepared. He has been filing disclosure statements since he first ran for district Judge in 1983 and has timely filed every since. He says he understands the necessity for a candidate to file statements timely, but asks that we please consider that at this time he is not a candidate for anything and did not receive any contributions in 2012 or for several years prior to that. He respectfully requests a waiver of the assessment for his mistake.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
