Louisiana Delta Community College ("Delta") is a public community college under the management of the Board of Supervisors for the Louisiana Community and Technical College System (the "Board"). Delta is seeking to enter into a contract with Flying Tiger to provide aerial application flight training and ground school programming on a non-credit basis. Flying Tiger is owned by Barham Brothers, Inc. A former member of the Board, Erle Edwards Barham, has a 20% ownership interest in Barham Brothers, Inc. Mr. Barham resigned from the Board on September 10, 2013 due to medical reasons and did not attend any meetings thereafter. The Board approved Delta's proposal to enter into an agreement with Flying Tiger for professional services related to the pilot training program at its September 11, 2013 meeting. The proposed contract between Delta and Flying Tiger has not yet been executed. Further, Mr. Barham will not provide any services or participate in any way with the proposed contract.

La. R.S. 42:1121A(2) prohibits a former member of a board or commission from contracting with, being employed in any capacity by, or being appointed to any position by his former board or commission for a period of two years from the date of his resignation.
