Reconsideration of a waiver request submitted by Jeffery Scanlan, member of the White Lake Property Advisory Board, regarding a $1,500 late fee assessed for filing his 2011 Tier 2.1 annual pfd 116 days late.
Facts:
New Information: Mr. Scanlan has resigned from the White Lake Advisory Board. Mr. Scanlan states he cannot afford to pay this late fee. He has submitted documentation which appears to show that he has outstanding bills totaling approximately $100,000 relating to his farming business. These bills do not include his everyday living expenses.

Initial Information:



Mr. Scanlan states that he was unaware of the filing requirement and that he needed to file for the year before. He states the delay in filing 2011 was that he was sending the 2012 report instead 2011. It should be noted that the 2011 report was filed in March 2013 and the 2012 report was not filed until May 23, 2013.

Mr. Scanlan states that the late fee would impose a financial burden. A request for supporting documentation was submitted. Instead of submitting supporting documentation, Mr. Scanlan responded stating that he was not confirmed until July 4, 2012. However, he was appointed to the board on February 17, 2012.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

Recommendations:
Suspend all but $500 based on future compliance. The $500 is payable within 30 days unless other payment arrangements are entered into within 30 days. Failure to pay within 30 days or enter into a payment within 30 days will result in the full amount becoming due and owing.
