Advisory opinion request regarding whether an employee of Northeast Delta Human Service Authority may operate a private business that is monitored through a division of Northeast Delta Human Service Authority.
Facts:
Loria Pierce is employed as the Clinic Manager for Monroe Women's and Children Behavioral Health Clinic ("Women's & Children Clinic"), a division of Northeast Delta Human Service Authority. Women's & Children Clinic serves clients aged 6-17 with emotional behavioral disorders, clients aged 12-17 for substance abuse issues, and provides out-patient substance abuse treatment for women. Ms. Pierce has an ownership interest in Center for Personal Development, a private company that will provide personal care services/waiver services for clients that have been diagnosed with a developmental disability, Home Based Community Services to the elderly and disabled, and case management services to infants and babies who participate in the Early Steps Program.

Ms. Pierce provides financial oversight for Center for Personal Development and supervises the administrators of the programs. The Office for Citizens with Developmental Disabilities, another division of Northeast Delta Human Service Authority, monitors Center for Personal Development for the Home Base Community Services Waiver Session.

Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service which is substantially similar to the responsibilities, programs or operations of his agency and in which the public servant has participated.

La. R.S. 42: 1113A prohibits a public servant from bidding on or entering into any contract, subcontract or other transaction which is under the supervision or jurisdiction of his agency.

La. R.S. 42:1111C(2)(d) prohibits a public servant from providing compensated services to a person which has a contractual, business or financial relationship with his agency or which is regulated by his agency.

Recommendations:
Adopt the proposed advisory opinion.
