RE:
Consent opinion regarding William "Bud" Carrouche, the President of the New Orleans Firefighter Pension Board (Pension Board), being employed at a bank that has a business relationship with the Pension Board.
Facts:
Mr. Carrouche has agreed to the language in, paid the fine and signed the consent opinion.
Comments:
The Board offered Mr. Carrouche a consent opinion with a $1,000 fine and finds a violation of La. R.S. 42:1111C(2)(d).
Law:
LA. R.S. 39:1233.1 allows a member or chief executive officer of a local depositing authority to be a compensated, or uncompensated, officer, director, or employee of a bank provided he recuses himself from voting in favor of the bank and discloses those transactions. Section 1111C(2)(d) of the Code prohibits a public servant from providing compensated services to a person that has or is seeking a contractual, or other business or financial relationship with his agency. LSA-RS 39:1211 defines "local depositing authority" as all parishes, municipalities, boards, commissions, sheriffs and tax collectors, judges, clerks of court, and any other public bodies or officers of any parish, municipality or township.

Section 1111C(2)(d) of the Code prohibits a public servant from accepting anything of economic value for services rendered from a person who has a business contractual or financial relationship with the agency of the public servant.

Recommendations:
Publish the consent opinion.
