RE:
Advisory opinion request from a Division of Administration, Office of Planning and Budget (OPB) employee Johnathan Walker regarding whether a company in which he is part owner would be prohibited by the Ethics Code from contracting with the Louisiana Department of Transportation and Development (DOTD).
Facts:
Jonathan Walker is currently employed as a budget analyst for OPB. As a budget analyst, his duties include assisting in the development and administration of House Bill One. His unit focuses on the appropriations and budgetary policies regarding the Louisiana Department of Health and Hospitals. Mr. Walker was formerly employed as a budget analysts for DOA in the Capitol Outlay Section of the Office of Facility Planning and Control from 2008 until 2013. As a budget analyst for the Capitol Outlay Section he assisted in preparing the Governors annual budget for statewide construction projects and capitol projects.

Mr. Walker's Company would provide industrial and construction work, generally related to concrete crafting, cutting and finishing for roadways, site work and demolition. Mr. Walker has stated he would own up to 25 percent of the company and provide services as the company's business/office manager. Mr. Walker has stated that there are other owners and he would not possess a controlling interest in the company.

Law:
La. R.S. 42:1102(2)(a) means the department , office, division, agency, commission, board, committee, or other organizational unit of the governmental entity.

La. R.S. 42:1113A.(1)(a) No public servant or member of his immediate family or legal entity which he has controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Adopt the proposed advisory opinion.
