| Advisory opinion request submitted by Bogalusa Medical Center (BMC) employees, Dr. John Sebatier and Dr. Ghulam Arain, regarding whether the post employment restrictions would prohibit them from contracting with LSU Health Care Services. |

Dr. Sebatier and Dr. Arain submitted a request for an advisory opinion regarding whether the post-employment restrictions would prohibit them from contracting with LSU Health Care Services. The Doctors were employed by BMC as physicians. The Doctors were civil service employees who were employed on a PRN or "as needed" basis by BMC. The BMC is a health care facility which is owned and operated by LSU Health Care System. LSU plans to enter a partnership with the Franciscan Missionaries of Our Lady Health Systems. Once the partnership is effective BMC will become Our Lady of the Angels Hospital (OLOAH). The New Hospital will be staffed by both OLOAH and LSU physicians.
The following employees of BMC, Darryl Hughes, Chris Perret, Lisa Brooks, Damon Fortenberry, and Hal Lamb initially submitted advisory opinion request however they have withdrawn them as they are moot as they have all directly contracted with OLOAH and do not intend on contracting with LSU Health Care System.

La. R.S. 42:1102(2)(a) "agency" to mean a department, office, division, agency, commission, board, committee, or other organizational until of the governmental entity.
La. R.S. 42:1121B prohibits a public servant, for a period of two years following the termination of his public employment, from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.

Adopt the proposed advisory opinion for Dr. Sebatier and Dr. Arain. Allow the withdrawal of the advisory opinion request by Darryl Hughes, Chris Perret, Lisa Brooks, Damon Fortenberry, and Hal Lamb.
