RE:
Advisory opinion request from Valerie Horton former Department of Transportation and Development (DOTD) employee regarding the applicability of the post employment restrictions.
Facts:
Ms. Horton has requested an advisory opinion regarding whether Section 1121 of the Code of Governmental Ethics(Code) would prohibit her from seeking employment as a consultant to work on new projects with DOTD.
Ms. Horton was employed as an Engineer 6 DCL for DOTD from February 4, 2008 until March 1, 2014. Ms. Horton was employed as a Program Manager within the Transportation Enhancement Program.(TEP) Ms. Horton also served as the liaison for the Scenic Byway and Recreational Trails Program's. Ms. Horton has stated that she was to ensure that information on the projects and programs were entered into DOTD's computer system and that the projects were properly authorized. Ms. Horton stated that she understood that she could not work on any projects that she worked on as project manager. Ms. Horton did not serve as an agency head in her employment with DOTD.

Law:
La. R.S. 42:1121B No former public employee shall for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction or in an appearance in connection with a transaction in which such former public employee participated at any time during his employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render any service which such former public employee rendered to the agency during the term of his employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.

Recommendations:
Adopt the proposed advisory opinion.
