An appearance in connection with a request that the Board waive the $1,400 campaign finance late fee assessed against D. Nicole Sheppard, a candidate for Judge, Traffic Court, Division D, Orleans Parish in the October 19, 2013 election, whose 10-G campaign finance disclosure report was filed 14 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Darleen Nicole Sheppard states that it was her true intent to follow all guidelines set out by the Ethics department. She said they made several calls to the Ethics' office to ensure her compliance. She states the information posted on the Ethics' website was not clear. She says she followed the schedule as posted, so she did not know she was not in compliance until she received documentation from our office. Upon receipt of the communication she states they immediately filed the overdue report. She says they also have other challenges that has made this process difficult.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
