Request that the Board waive the $440, $1,000 and $160 campaign finance late fees assessed against Marsha Lincoln-LeJeune, a candidate for Member of Parish Council, District 7, Plaquemines Parish in the October 2, 2010 election, whose Special, 10-P and 40-G campaign finance disclosure reports were filed 11, 26 and 57 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Marsha Lincoln-LeJeune states that from the first time she received a letter from the Ethics Board explaining that they mailed the expenditure report to the wrong address, she has been trying to get this issue resolved. She said after losing the election, she lost her job as Jeff Edgecombe's politically appointed administrative assistant and only received unemployment of $800 per month compared to $2,000 per month as an administrative assistant. She says she recently started working only part time at the Plaquemines Parish Sheriff's Office at $13.65 per hour, which barely pays her monthly bills. She says she has to make monthly payments for student loans and payments to the IRS (paperwork attached). She is not interested in ever running for a political position again in Louisiana.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $200 on the Special report and 10-P and decline to waive on the 40-G.
