In connection with her request that the Board waive the late fee assessed for the late filing of the report, Ellen M. Hazeur states that she takes full responsibility for the tardiness of the report. She is seeking a waiver or alternatively, a reduction of the penalty and respectfully request that the Board consider the following information in making this decision. She states this campaign account was for an unsuccessful 2011 election. Since the previous report was filed, no transactions have been made regarding this account; no contributions were received and no expenditures were made. She states that because this account was for a prior election for an office that she did not ascend to, and since no transactions were made regarding the account, she mistakenly believed that she did not have to file a report. When she was informed that this was not correct, she immediately filed the report, albeit a few days late. She states she first ran for public office in 1993 and currently serve as First City Court Clerk in Orleans Parish. Since 1993, she has had to submit numerous reports to the Ethic's Board. She does not believe that she has even been fined for submitting a late report. She says she has always respected the rules of the Ethics Board and have done her best to follow the same. She says as this is the first time that she has been tardy with a campaign report, she asks for leniency in this matter.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
