Waiver request submitted by John King, Lafourche Parish Coroner, regarding a $2500 late fee assessed for filing his 2011 amended Tier 2 annual pfd 143 days late.
Facts:
Attorney William Credo submitted a waiver request on Dr. King's behalf. Mr. Credo states that a former secretary sent in the 2012 report. After receiving the Notice, it required 145 days to complete it while attending to his office. Mr. Credo states that Dr. King is a coroner and does not have the luxury of not responding to coroner calls. He is on call at all times. Because of the nature of the coroner position, he relied on his office staff to complete the forms. Mr. Credo also states the fine is excessive and does not require a maximum fine. This is incorrect. $2,500 is the maximum fine allowed by statute.

A review of the database records indicates that Dr. King filed his report after receiving his "second notice". The NOD-Amend required Dr. King to disclose his income from Lafourche Parish Government as Coroner on Schedule D. He previously disclosed the information on Schedule E.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Waive the late fee.
