Advisory opinion request concerning post-employment restrictions that would apply to Daniel Rees, a former employee of the Office of Community Development Disaster Recovery Unit within the Division of Administration.
Facts:
Daniel Rees was formerly employed as Executive Counsel for the Office of Community Development Disaster Recovery Unit within the Division of Administration (OCD-DRU) and his direct supervisor was the Executive Director of the Office of Community Development. OCD-DRU no longer has a legal unit, with its functions now being centralized in the Office of General Counsel for the Division of Administration. Mr. Rees is considering providing non-legal services as a subcontractor to a grant management firm which is seeking a contract with OCD-DRU to provide grant management services related to grant administration for Hurricanes Katrina, Rita, Gustav, Ike and Isaac. The work Mr. Rees did while employed with OCD-DRU was within the legal department and he was not responsible for the administration of individual grant files.
Law:
1121B(1) of the Code of Governmental Ethics states that no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed. Section 1121B(1) goes on to prohibit a former public employee, for a period of two years following the termination of his public employment, from rendering any service which such former public employee had rendered to the agency during the term of his employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
