Nicholas J. Muscarello, Jr. asked whether he may work as a contract attorney for Tangipahoa Parish Sewer District No. 1 ("District) while his father serves as a Tangipahoa Parish Councilman. The Tangipahoa Council created the District as a public corporation and political subdivision of the state pursuant to La. R.S. 33:3881. The District is governed by a board of five commissioners which are appointed by the Tangipahoa Council. La. R.S. 33:3881 provides that the District will function under the authority of the Tangipahoa Council.
Mr. Muscarello's employment contract would be with the District and his position would be overseen by the District's board of commissioners.

La. R.S. 42:1113 prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
