RE:
Request that the Board waive the $480 campaign finance late fee assessed against Matt Jones, a candidate for Sheriff, Union Parish in the April 5, 2014 election, whose 30-P finance disclosure report was filed 8 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Matt Jones states that he respectfully requests a waiver of the penalty due to circumstances that resulted in the late filing of the required report. Mr. Jones stated that in filing the report there was some confusion resulting from a conversation with a representative of the Board of Ethics.

He indicates that it was his understanding that the time for filing the campaign finance report would be furnished to him along with the user ID and password necessary to access the software and report online. He indicates that he did not receive the user ID or the password which would have allowed them to access the online report. This was a special election to fill an unexpired term and they were uncertain of the reporting deadlines and from his earlier conversation with the Louisiana Board of Ethics personnel he erroneously waited for correspondence from the Board of Ethics. He indicates that the net result of this confusion was the report was filed late, but he states he filed promptly upon receipt of the necessary software access information.

He states that there was no intention to mislead anyone by filing the report late as there actually was no information or activity filed in the report.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
