Waiver request that the Board waive the $700 campaign finance late fee assessed against Ernest Charbonnet, a candidate for Judge, Traffic Court, Division A, Orleans Parish in the October 22, 2011 election, whose 2013 Supplemental finance disclosure report was filed 7 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Ernest Charbonnet states although ignorance of the law is no excuse, he is requesting a waiver for the $700 in fees because of confusion on his part. In the last campaign cycle he was running for Council at Large in New Orleans. His campaign filed a report for the election day expenses, and then another report after that.

He was completely unaware that there was another supplemental report due from his previous campaign for Traffic Court in 2011 because there was no activity. He further states that during both of these races, finances were very tight, and he was not able to afford professional accounting services, rather relying on the efforts of volunteers who are not experts in the rules of campaign finance. He says again this is no excuse for not filing the report on time, but since these are his first fines, he is asking for some lenience with this matter.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Decline to waive the late fee.
