Advisory opinion regarding whether Robert Pell, a former Plans Examiner for the Vieux Carre' Commission, may perform work on projects as an architect that fall under the jurisdiction of the Vieux Carre' Commission.
Facts:
Robert Pell was employed as a Plans Examiner with the Vieux Carre' Commission from September 2009 until October 19, 2012. The Vieux Carre' Commission is the agency tasked with reviewing and permitting exterior work to buildings within the French Quarter in New Orleans.

Mr. Pell was responsible for reviewing plans and helping owners and architects find appropriate design solutions that fit within the context of the French Quarter. Mr. Pell states he has not been appointed nor is he a department head.

Since his termination of his employment, Mr. Pell has obtained his architectural license and established an architecture firm in New Orleans.

Mr. Pell wrote permits for numerous properties while employed with the VCC.

Law:
La. R.S. 42:1121B provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.

Recommendations:
Adopt proposed advisory opinion.
