Advisory opinion request from Emily Bellaci, Chair of the Louisiana Behavior Analyst Board, regarding donations, grants and gifts of money made to the Louisiana Behavior Analyst Board.
Facts:
Emily Bellaci, Chair of the Louisiana Behavior Analyst Board (LBAB), stated that LBAB was created by Act 351 of the 2013 Legislative Session which mandates licensure of behavior analysts, state certification of assistant behavior analysts and registration of line technicians performing applied behavior analysis services in Louisiana. Pursuant to Act 351, Section 3704(10), LBAB may "accept grants, donations, or gifts of money or services from public or private individuals or organizations or from any other sources to be utilized for the purposes of the Board. Such monies shall be deposited into the treasury of the Board."

LBAB is a self-funded Board and receives no money from the general fund. Ms. Bellaci asked several questions concerning reporting requirements and limits for donations made by an advocacy organization or other private/public grants, donations, or gifts received by LBAB. She also posed hypothetical situations concerning sources of donations that may be prohibited.

Recommendations:
Decline to render an advisory opinion.
