RE:
A request that the Board waive the $1,000 and $240 campaign finance late fees assessed against James Salsbury, a candidate for Chief of Police, City of Central, East Baton Rouge Parish, in the April 5, 2014 election, whose 30-P and 10-P campaign finance disclosure reports were filed 26 and 6 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the reports, Malcolm D. Cain, campaign manager for James Salsbury, states that when he accepted the challenge to help with Mr. Salsbury's campaign, he was somewhat naive as to the amount of work that was involved in actively participating and running a campaign. During the latter phase of the campaign, his opponent or opponent's followers began to attack the family of Mr. Salsbury and he had to continuously respond and clarify the misleading information.

He spent many hours performing these duties, as well as walking neighborhoods, contacting supporters and finding ways to generate positive support from the public. He said he did submit the first major report and after submitting, had very limited expenditure or donation activity on the 30 day report and none on the 10 day report. As soon as it was brought to his attention that he overlooked the reports, he immediately submitted both the same day. The campaign has no further campaign funds, therefore he will have to cover the late fees himself. He will have to borrow the money which will put a hardship on his family. He is asking the Ethics Board to reduce or suspend the late fees.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Decline to waive the late fees.
