| Advisory opinion request regarding whether Shantel Lege, the Region 3 Manager for the Office of Motor Vehicles may supervise her mother, Bernall Lemaire. |

Bernall Lemaire is the office manager of the Crowley Office of Motor Vehicles (COMV). She reports to the Region 3 Motor Vehicle Manager, Shantel Lege. Bernall Lemaire is the mother of Shantel Lege. Ms. Lege became detailed as region manager for Region 3 on April, 14, 2014. This position supervises the COMV managed by Ms. Lemaire. Ms. Lemaire was promoted to the office manager of the COMV on November 26, 2012.
Ms. Lemaire would report inventory, office wait times, and production to Ms. Lege. Ms. Lege is contacted by office managers if there are any problems with customers, paperwork or anything in the office. When she is notified by administrators that overtime is being offered, she passes this information to the office managers for them to notify their employees. She enters payroll for the office managers but states that she will have the back-up enter Ms. Lemaire's.

1119A- no member of the immediate family of an agency head shall be employed in his agency.
1119C(2)- The provisions of this Section shall not prohibit the continued employment of any public employee nor shall nor shall it be construed to hinder, alter, or in any way affect normal promotional advancements for such public employee where a member of public employees' immediate family becomes the agency head of such public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family member becoming the agency head.
1102(3)-An agency head is an administrative officer of an agency who exercises supervision over the agency.
1112B(1)- Prohibits a public servant from participating in a transaction involving the governmental entity in which, to her actual knowledge, any member of her immediate family has a substantial economic interest.
1112C- Every public employee shall disqualify himself from participating in a transaction involving the governmental entity when a violation of this Part would result.
