Advisory opinion request regarding whether Dominic Cali an employee of the Louisiana Department of Transportation and Development may provide private consulting work to other state agencies.
Facts:
Mr. Cali performed the role of ERP project manager during the implementation of LaGov as the section head for the Information Technology Section (Section 13) for DOTD. The DOTD program was used as the pilot for LaGov. He retired from DOTD on July 31, 2011 as a program manager. From August 1, 2011 to the present Mr. Cali has worked part-time with DOTD to assist its staff with post go-live assistance with LaGov.

His primary focus with DOTD is sharing DOTD specific knowledge with DOTD staff on pre-LaGov data that was converted to LaGov and in LaGov and how to access DOTD data and perform analysis on the data. This includes conducting workshops on reporting and information retrieval. Through this process he has developed several reports that have become part of the DOTD work-flow.

Law:
Section 1111C(1)A of the Code of Governmental Ethics (Code) states: No public servant shall receive any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.




Recommendations:
Adopt the proposed advisory opinion.
