RE:
Waiver request submitted by Pamela Olson, a member of the Louisiana Serve Commission, regarding a $1,500 late fee assessed for filing a 2012 Tier 2.1 annual pfd 46 days late.
Facts:
Ms. Olson has submitted payment of the late fee, but she is also requesting a waiver.

Ms. Olson questions her requirement to file pfds as an ex-officio member of the Louisiana Serve Commission. The Board has stated that ex-officio members are required to file. Further, in Docket No. 2008-603, the Board advised that members of the Louisiana Serve Commission are required to file pfds.

Ms. Olson states that she serves on the Louisiana Serve Commission as a requirement of her federal position. She states that the penalty is cruel and painful to exert on a retired federal employee. She states that she submitted pfds until her final year when the staff of the Commission stated that they did not believe she needed to file. Her term ended on December 31, 2013. Her last report due is the 2013 pfd due by May 15, 2014. The 2013 pfd has been filed.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

Recommendations:
Suspend all but $250 based on future compliance and payment within 30 days.
