Advisory opinion request regarding whether Perry Fleming may run for the office of Chief of Police for the Town of Mangham in the November, 2014 election after resigning his current position as Interim Chief of Police.
Facts:
On February 11, 2014, Perry Fleming resigned as Mangham Town Councilman and was appointed by the Mangham Town Council to serve as Chief of Police after the retirement of Chief Lennie Graham. Prior to taking office, Mr. Fleming consulted with the Secretary of State and was informed that he could run for the office of Police Chief at the end of the appointed term. The town of Mangham has a total population of 672 and has a limited number of experienced law enforcement officers.
Law:
La. R.S. 42:1121A(2) prohibits a former member of a board or commission from contracting with, being employed in any capacity by, or being appointed to any position by his former board or commission for a period of two years from the date of his resignation.
Recommendations:
Adopt the proposed advisory opinion.
