RE:
Advisory opinion request regarding whether Jade Lambert, an employee of Bunkie General Hospital may receive a promotion to supervisor while his mother, Katy Juneau is employed by the hospital as an emergency room LPN.
Facts:
Avoyelles Parish Hospital Service District No. 1 does business as Bunkie General Hospital (BGH). Jade Lambert currently works as an RN in the emergency room. The hospital would like to promote Jade Lambert to ER RN supervisor. Mr. Lambert has been employed with BGH since May 8, 2008. Jade Lambert is the son of Katy Juneau.


Katy Juneau has been continuously employed by BGH since February 6, 2006. She is currently employed as an LPN in the emergency room.

Corey Jeansonne is the Director of Nursing for BGH, as such, he is responsible for all personnel actions in the emergency room including evaluations, merit increases, promotions and disciplinary actions. The ER RN supervisor position does not have the responsibility of hiring, promoting nor discipline at BGH.

Finally, BGH will implement a disqualification plan to remove Mr. Lambert from any responsibilities regarding Katy Juneau. Corey Jeansonne will be the supervisor of Ms. Juneau.


Law:
Section 1119A states that no immediate family member of an agency head shall be employed by his agency.
Section 1102(13) defines immediate family member to the public servant as his children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.

Section 1102(3) defines agency head as the chief executive or administrative officer of an agency or any member of a board or commission who exercises supervision over the agency.

Section 1119C(2) states the provisions of this Section shall not prohibit the continued employment of any public employee nor shall nor shall it be construed to hinder, alter, or in any way affect normal promotional advancements for such public employee where a member of public employees' immediate family becomes the agency head of such public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family member becoming the agency head.

Section 1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.
